It then explores the rights an owner of land has if a particular regulation of land is either inefficient, unfairly burdensome, unfairly disruptive of the owner's settled expectations, or an infringement upon the owner's civil liberties. It develops a typology of the kinds of regulatory and market-based tools that are available to control land use, and provides a framework for evaluating the appropriateness of alternative tools. It begins by discussing why and when government regulation, rather than private market ordering, might be necessary to control the use of land. This course examines how land development and use is regulated and controlled. Students submit written questions for the author and prepare short papers critiquing the work and the author's defense of the work. With the author and other invited guests.
In colloquium sessions, students discuss the work In background sessions, students learn the law, theory and methodology necessary to discuss the work in progress with its author. We will meet with nationally prominent scholars and practitioners in law, economics, sociology, and public administration to discuss research in progress on these issues. But there is a lot we don't know about how accurate those tools are, what legal disputes they may generate, what effects they will have on housing and labor markets, the distribution of wealth, and the political and policy debates of the future. As governments at all levels strive for greater equality, some are adopting racial impact statements and other tools for predicting and evaluating the effects current policies will have on racial equity. Much of the current wealth gap between Black and Brown households and white households can be traced to land use and housing decisions of the past.

This course will allow students to explore the theoretical and empirical underpinnings of current debates about how to evaluate the effects land use and housing policies will have on racial equity. Under her leadership, the Furman Center has become the nation’s leading academic research center devoted to the public policy aspects of land use, real estate, and housing development, and was a recipient of the MacArthur Award for Creative and Effective Institutions in 2012. Been also previously served as Commissioner of Housing Preservation and Development for the City of New York from 2014-17.īeen has been on the faculty at NYU since 1990 and focuses her scholarship on the intersection of land use, urban policy and housing. In that role, she led 20 agencies and mayoral offices and a team of more than 30,000 people in financing the new construction and preservation of 200,000 homes on budget and two years earlier than promised securing the first comprehensive rezonings intended to redress the lack of affordable housing in resource rich, segregated neighborhoods revamping leadership at the nation’s largest public housing authority and conceiving and designing a pandemic research institute to lead the world in preparing for future health emergencies. Been returned to NYU in January 2022 after serving as deputy mayor for housing and economic development of the City of New York from May 2019 to December 2021. Vicki Been is the Judge Edward Weinfeld Professor of Law at NYU School of Law, an Affiliated Professor of Public Policy of the NYU Wagner Graduate School of Public Service, and faculty director of NYU’s Furman Center for Real Estate and Urban Policy.
